CHAPTER I. OUR SALES POLICY

A "Customer" is herein defined as any individual making a purchase for personal, non-professional, or non-business-related purposes. The Website retains the prerogative to decline orders originating from parties failing to meet this customer definition or orders contravening its sales policy. It is expressly stipulated that all online sales conducted through the Website are exclusively subject to the governance of the General Terms of Sale (GTS), which take precedence over any other documentation, including terms and conditions pertaining to alternative marketing and distribution channels.

Upon initiating an order for a product on the Website, the customer unequivocally acknowledges and agrees to the General Terms of Sale (GTS). No physical signature is necessitated for this acceptance. Furthermore, the customer's utilisation of the Website is contingent upon compliance with the website's legal notice, which can be accessed at bakedclaylondon.com/legal and is likewise embraced by the customer without reservation.

It is hereby established that the Customer is permitted to archive or produce a hard copy of the existing General Terms of Sale (GTS), provided that no alterations are made to their content. Baked Clay retains the authority to revise the GTS at its discretion, particularly in response to modifications in relevant regulations or standards. In such an event, the updated version will become effective upon its publication date on the Website.

CHAPTER II. ONLINE PURCHASES

The order form comprehensively encompasses vital order-related details, including the pricing of the Product(s) (inclusive of relevant taxes), the various payment and shipping options at your disposal, as well as the associated shipping charges.

The offered Products are those displayed on the Website at the time of the Customer's visit, contingent upon product availability. Upon the formalisation of the contractual agreement, Baked Clay proceeds to process the order with due diligence.

Each order form is securely archived within our database for the duration necessary for order fulfilment, and in compliance with prevailing legal mandates. Customers have the convenience of accessing their order forms by logging into the Website and navigating to the "My Account" section, followed by "My Orders."

The availability of Products for purchase is contingent upon their stock levels, and any reference to these levels on the Website serves as an approximate indicator, subject to the frequency of updates. In the event that a Product becomes unavailable, the Customer will receive prompt email notification regarding the cancellation of the entire order or a portion thereof. Consequently, any order placed for an unavailable Product, for which payment has been tendered, will not entail any form of compensation or indemnification, except for the reimbursement of the Product's purchase price and any relevant shipping charges.

Baked Clay's inventory strictly comprises new goods and products that meet or exceed prevailing market standards, and it does not engage in the sale of second-hand items or defective merchandise.

All Product prices are non negotiable and are as displayed on each respective Product page of the Website, except in cases of typographical errors. These prices encompass the Value Added Tax (VAT) applicable at the time of order placement. Shipping and handling charges, which are consistently a fixed, predetermined amount, will be itemised in addition to the Product prices during the order placement process, and customers will receive notification of these charges.

Baked Clay retains the prerogative, which the Customer acknowledges and accepts, to modify its pricing at any time, without the need for any formalities beyond the application of these changes to the Website. It is essential to note that such alterations will not affect orders accepted by the Website prior to the implementation of these modifications, contingent upon Product availability.

All Products are accompanied by an identifying tag. In the event of a return, the Customer is expected to keep both the tag and the seal on the one-time-use packaging of the purchased Products intact. In case a Customer opts to exercise their right to return an order, Baked Clay reserves the right to decline the return of Products lacking their tags, those with altered essential or qualitative attributes, or those that have incurred damage.

CHAPTER IV. ORDER PLACEMENT PROCESS

Customers have the liberty to peruse the various webpages on the website in order to acquaint themselves with the array of products available for acquisition, without any obligation to finalise a purchase. To initiate an order, it is imperative that customers log in using their designated personal username and password.

Upon initiating their inaugural order on the website, customers are prompted to designate a username, typically their email address, and establish a password for the purpose of customising their subsequent visits. Additionally, they will be requested to provide essential information necessary for the seamless processing and fulfilment of their orders.

Subsequently, upon each visit to the Website, customers have the option to authenticate themselves by entering their designated username and password. This combination of credentials serves as conclusive evidence of the customer's identity.

It is the individual responsibility of each customer to safeguard their username and password. In the event of a forgotten password, customers may utilise the "Forgot Your Password?" feature to receive an email containing a link for resetting their password.

The data furnished by customers and gathered by Baked Clay is handled with the utmost confidentiality and securely stored within Baked Clay's database. Under no circumstances will this information be transferred, sold, communicated, or disclosed to third parties or business partners in any manner, except as permissible under applicable law and as delineated in the Website's Privacy Policy, which customers acknowledge having perused.

To initiate an order, the customer must add the desired product(s) to their shopping cart or remove them to rectify any errors. Prior to finalising the order and proceeding with the payment by selecting "CHECKOUT," the customer is afforded the opportunity to meticulously review the order details and rectify any inaccuracies by returning to their shopping cart.

Subsequently, the customer is required to confirm the order and designate their preferred payment method on the same page by checking the box adjacent to the statement, "I have read and accepted the terms and conditions." The consummation of the sale is contingent upon Baked Clay dispatching an order confirmation email to the customer.

This order confirmation email will encompass essential details, including the order number, the product(s) selected by the customer along with their respective prices, the chosen shipping method and estimated delivery timeframe, as well as provisions for order cancellation and return via the customer's account. Additionally, the email will furnish the contact information for Customer Service should the customer have any inquiries or require further assistance regarding their order.

CHAPTER V. PAYMENTS

Customers are required to adhere to the instructions outlined on the order form for the settlement of both the Product prices and associated shipping charges.

In the case of payments executed via credit or debit card, the financial particulars, encompassing the card number and expiration date, are transmitted to SHOPIFY or other financial institutions providing remote payment services through an encrypted protocol. This stringent security measure ensures that, under no circumstances, will third parties be granted access to such sensitive information. Baked Clay shall exclusively employ this data to facilitate the completion of the purchase procedures on behalf of the Customer, issue refunds in instances of Product returns conducted under the Customer's right to return, or communicate any detected fraudulent activities on the Website to the appropriate law enforcement authorities.

The security of your card payments is ensured through the utilisation of the 3D Secure platform, which incorporates an additional layer of cardholder verification, facilitated by a secure, one-time code transmitted via text message. Your bank is only able to authenticate the payment once this secure code has been input. It is important to note that Baked Clay does not retain any of your financial information. All refund transactions are securely transmitted via encrypted methods.

The total cost of the Product(s) and associated shipping fees as displayed on the order form will be debited from your payment account at the time of the Product(s) purchase.

Kindly be aware that we do not accept payment by cheque.

Baked Clay retains the prerogative to decline any orders or shipments under certain circumstances, including if the Customer exceeds the stipulated limits, is embroiled in an ongoing dispute, maintains an outstanding balance from a prior order, or if the financial institution rejects the card payment. The Customer warrants that they possess the requisite authorisation to employ the selected payment method at the time of placing the order. In the event of a payment decline by the bank, the order will be automatically cancelled, and the Customer will receive notification via email.

Customers are strongly encouraged to retain their order summaries.

Order information is securely maintained within the information systems of Baked Clay and its collaborating banking institution. These records serve as authoritative evidence for all transactions conducted on the Website between the parties.

The Website is equipped with a robust security system.

Baked Clay provides assurance that the encryption techniques and services employed to safeguard transactions have been duly authorised or reported in accordance with prevailing legal requirements.

CHAPTER VI. SHIPPING

For all orders confirmed by 10 am, Monday through Friday (excluding holidays), Baked Clay commits to dispatching the products on the very same day. The chosen carrier for these shipments is UPS, with the service encompassing Home Delivery using Standard UPS in DDP, exclusively within the United Kingdom.

With the exception of promotional events, the delivery fee on orders differ depending on the service and country you choose.

The anticipated timeframe for receiving the package varies between 3 to 5 business days from the moment of order confirmation by Baked Clay, contingent upon the specific destination country. Products are typically delivered within this specified period, dependent on the shipping location. It is imperative to note that any delays in delivery beyond the stated timeframe are solely the responsibility of the carrier and will not, under any circumstances, result in compensation for the Customer.

It's worth mentioning that free shipping may be available for purchases exceeding a designated amount. In any case, all shipping charges are transparently communicated to the Customer during the order placement process.

in the interest of security, it is imperative that orders are not designated for delivery to locations such as hotels, temporary accommodations, general delivery at post offices, PO boxes, non-permanent residences, or shared spaces where a specific, enduring individual or legal entity address cannot be attributed. This category includes, but is not limited to, mobile homes, trailers, and campgrounds.

Customers are strongly advised to exercise due diligence when furnishing address details on the order form, with particular attention to the shipping address. In the event of a Customer error in specifying the shipping address, the carrier will return the package marked as "NATA" (signifying "not at this address").  In such instances, the Customer remains liable for the associated shipping costs.

In the event a Customer reports a missing Product, it's important to note that the investigation carried out in collaboration with the carrier may extend for up to 21 business days. If, within this period, the missing Product is successfully located, it will promptly be re-dispatched to the shipping address initially provided in the order. Nevertheless, should the missing Product remain untraceable beyond this specified timeframe, Baked Clay will proceed to reimburse the Customer for the absent Product that was originally requested.

CHAPTER VII. PACKAGING

Each of our orders is packaged with the greatest care and only recycled and recyclable materials are used. 

CHAPTER VIII. RETURNS &
EXCHANGES 

In accordance with the stipulations set forth in the British Consumer Code, Customers are granted a 14-day timeframe within which they may initiate returns for the Products they have ordered. Baked Clay has extended this return period to 30 days for items procured through the website. This specified period commences on the first business day following the date of order delivery, or in the case of orders dispatched in multiple parcels, upon receipt of the final product.

All returned Products are expected to be in pristine condition, complete, unblemished, and enclosed in their original packaging, inclusive of any gift or customised packaging, bags, pouches, labels, identification tags, single-use seals, and the like.

The process of initiating a product return is straightforward and entails completing the provided return slip attached to the order. Customers can return undesired items employing the return label included within the order.

For assistance or further clarification regarding this procedure, or to request a replacement return slip or a pre-paid return label in the event of misplacement, our Customer Service team is readily available for contact.

All returned Products undergo a thorough inspection process. Any returned Products found to be incomplete, damaged, used, or soiled will not be accepted and may, at the discretion of Baked Clay, either be returned to the Customer at their own expense or retained by Baked Clay. It's important to note that requests for refunds or exchanges cannot be accommodated in-store under any circumstances.

Upon fulfilling the aforementioned return conditions, Baked Clay will promptly initiate a refund to the Customer for all expenses associated with the returned Products, in adherence to the British Consumer Code. This refund will be executed within 14 days from the date on which the Customer exercised their right to return. The reimbursement will be processed through the same payment method used for the original purchase.

In cases where the recipient of the Product(s) differs from the individual who made the payment, the refund for the return will consistently be directed to the party responsible for the order payment.

CHAPTER IX. PRODUCT WARRANTY

Customers are entitled to the protection afforded by the compliance warranty, as defined within the Consumer Code, along with the legal warranty against concealed defects, as outlined in the British Civil Code.

The seller is obligated to uphold a warranty against latent defects within the sold item, which render it unsuitable for its intended purpose, or impair its utility to such an extent that the buyer would not have acquired it, or would have offered a reduced price had they been informed of these defects.

CHAPTER X. PERSONAL INFORMATION

The provision of the requested personal information when making an online purchase is obligatory, as it is essential for order processing, shipment, and invoice generation. All such information is treated with utmost confidentiality. Failure to furnish the requisite information will result in the automatic rejection of the order. In adherence to Data Protection regulations, the processing of personal data collected through the Website has been duly registered with the ICO (Information Commissioners Office).

Customers maintain the right to access, modify, correct, and delete their personal data. To exercise this right, Customers are required to initiate the process by sending an email to legal@bakedclaylondon.com.

Customers may also receive informational emails from the Website pertaining to Baked Clay's Products and activities. It is within the Customer's prerogative to opt out of these communications either by abstaining from providing consent when creating their account on the Website, or by managing their preferences on their account management pages, or by utilising the unsubscribe link within any of these informational emails, or by directing their request to legal@bakedclaylondon.com.

Customers possess the ability to terminate their personal accounts by forwarding their request to legal@bakedclaylondon.com. Additionally, Baked Clay retains the right to terminate a Customer's account without prior notice, formalities, or compensation, either via email or postal communication, in instances where the Customer employs the e-commerce service or the Website in contravention of public policy and/or public decency, infringes upon Baked Clay's intellectual property rights, or engages in the misappropriation or unauthorised use of their username and password. It is imperative to understand that Baked Clay cannot, under any circumstances, be held liable by the Customer or any third party for the account termination as delineated in this provision.

CHAPTER XI. INTELLECTUAL PROPERTY

The intellectual property rights associated with the Products available for purchase on the Website are and will continue to be the exclusive domain of Baked Clay. All rights of utilisation are strictly and solely reserved for Baked Clay. Consequently, no individual or entity is authorised to reproduce, exploit, disseminate, or employ these intellectual property rights, whether in whole or in part, for any purpose, without the prior written consent of Baked Clay. It is pertinent to note that the Baked Clay brand and logo are duly registered trademarks, and any unauthorised replication thereof will constitute an act of infringement.

CHAPTER XII. COMPLAINTS &
MEDIATION

Should any inquiries or concerns arise, Customers are encouraged to initiate communication with Baked Clay's customer service team through the provided contact details, which include email, telephone, as indicated on the contact page, or by sending a written correspondence to Baked Clay's corporate headquarters situated at 71 - 75 Shelton Street, Covent Garden, London, WC2H 9JQ, United Kingdom.

CHAPTER XIII. MISCELLANEOUS PROVISIONS

Product ownership is exclusively transferred to the Customer upon the full payment of the Product price. However, the associated risks, encompassing loss, theft, or damage of shipped Products, are assumed by the Customer only from the date of their actual delivery.

Baked Clay shall not be held liable for the complete or partial inability to fulfil its obligations, in the event of a force major occurrence, as recognised by applicable case law in the United Kingdom. Such an event must be unforeseeable, unavoidable, and beyond the control of Baked Clay, hindering the company's contractual performance. In such a scenario, Baked Clay will duly inform the Customer, presenting one or more alternative solutions. The emergence of such an event constitutes valid grounds for the suspension and/or termination of Baked Clay's obligations toward the Customer, without incurring any liability on the part of the Customer.

Baked Clay meticulously archives all orders and payment receipts on durable, reliable media, in full compliance with prevailing legislation. It is mutually acknowledged by the parties that Baked Clay's computerised records serve as evidentiary proof of the communications, orders, payments, and transactions that transpired between them.

The Customer concurs that all electronic correspondence, communication, and information exchange between Baked Clay and the Customer hold the same evidentiary weight as if they were documented on paper.

In the event that any of the clauses delineated in the General Terms of Sale (GTS) is rendered null and void by existing legislation or a definitive court verdict, it will be deemed void but shall not annul the contract, nor affect the validity of its remaining
provisions.

CHAPTER XIV. APPLICABLE LAW

The present GTS and all orders are governed by law.
